Welcome to the Berkeley Diamonds ("the Site"). Berkeley Diamonds provides the Site as a service to its customers. By using this Site, you agree to follow and be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use this Site in any way.
Additionally, Berkeley Diamonds reserves the right to modify these Terms at any time without prior notification. Site users must agree to and abide by any such changes. Please review this page periodically for updates. Any use of our Site at any time constitutes full acceptance of these Terms.
Your Account and Password
If you set up an account on our Site, you must treat your login details as confidential. You must not disclose them to any third party. We have the right to disable any account at any time if, in our reasonable opinion, you have failed to comply with any of the provisions of these Terms.

Prices
Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice.
We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed under the same customer account, the same credit card, and/or orders using the same billing and/or shipping address.
In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email address, billing address, or phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.
Availability
All orders for Products are subject to the availability of those Products and the materials required to create them. We will inform you as soon as possible after receiving your order if, for any reason, the Products you have ordered are unavailable or subject to delay.
If we are unable to supply you with a Product, for example because a particular gemstone is out of stock or because of an error in pricing, we will inform you by email and will not process your order. If you have already paid for the Product, we will refund the full amount as soon as possible.
Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Berkeley Diamonds, its employees, representatives, affiliates, or agents be liable to you under contract, tort, strict liability, negligence, or any other legal or equitable theory for:
(a) any lost profits, loss of data, cost of procurement of substitute goods or services, or any direct, indirect, incidental, special, punitive, compensatory, or consequential damages of any kind whatsoever resulting from:

Any products provided through or in connection with the Services, including any allergic reactions, skin conditions, or other adverse effects allegedly caused by or connected with the use of our products.
These limitations apply regardless of the legal theory asserted, whether based on tort, strict liability, breach of contract, breach of warranty, or otherwise, and whether or not Berkeley Diamonds was advised of the possibility of such damages.
